		<description>Another reason the archaic 1872 or is that 1892 mining law should be shuttled for a more modern (or post-modern) law.  The categorical exclusion is the NEPA side-step dujour of the executive branch.   
 
Homeland Security has gone even further with the border fence by ignoring most of the &quot;enviro&quot; laws on the books.  Maybe if the U.S. asked Mexico to put the fence on their side (with the maquilas) where the environmental protections are not as stringent, we could avoid this problem (HA).
